Payment of any citation carries
certain consequences. Motor Vehicle convictions may result in points
assessed against your drivers license, increased insurance costs, and in
some situations suspension of driving privileges.
Any person pleading NOT GUILTY or seeking a reduction
of the charge must appear in court. Also, if you are charged with an
offense that requires a mandatory court appearance, you must appear in
court. Your court date, time and
location appear on the front of your citation.
If
you fail to appear in court as required, your drivers license may be
revoked and you may be arrested.

mandatory court appearance or if you do not have your citation and are
considering paying off your citation, click the Waiver List on the left
to determine if you must come to court or if you can waive your
appearance.
WAIVER OF APPEARANCE
Certain violations issued by
citation may not require a court appearance and can be paid prior to your
court date upon your PLEA OF GUILTY to the offense(s) and payment of
certain fines and court costs established by law.
On the back of your citation, the
officer indicated if your can waive your appearance and the amount of
fine and costs that is required. Complete the back of the citation and
click “Where to Make Payments” on the left for payment and mailing
instructions.
OLD TRAFFIC CITATIONS
If
more than 20 days has elapsed since your court date on a traffic
citation, it has been reported to DMV and you license has been suspended.
(This includes the DMV in the state
where your license was issued if different from North Carolina.)
If
the offense on your ticket can be waived (see waiver of appearance above), you can pay the ticket
including the additional “Failure to Appear” fee to dispose of the
charge.
If your charge requires a mandatory court appearance or you are
pleading not guilty, you must come to the District Court Judges Office between the hours
of 8:00 am and 8:30 am, Monday through Thursday, except Legal
Holidays. (That office is located on the Second
Floor of the Cumberland
County Courthouse
and telephone number is listed under “Directory of Court Offices” above).
The Clerk of Superior Court cannot assist you with a missed court
date. (Only you, or an attorney
acting on your behalf can handle this matter.)
Important Notices
Concerning Old Motor Vehicle (Traffic) Citations
If more than 20 days has elapsed since your court date
additional fees set by law have been accessed. (Click Court Costs to the left. On the Court Costs and Fees document,
look for “Failure to Appear” fee under “Other Criminal Fees”. )
If your license/privilege to drive has been suspended, additional
steps are required by the Department of Motor Vehicles in the state where your license was
issued to have your license reinstated/renewed. Contact that agency.
