CONTINUANCES

To Continue or Postpone Your Court Date

The Clerk of Superior Court CANNOT continue your case or assist you with requesting a continuance….. only a Judge can continue your case.

You, or your attorney, must personally appear in court on your court date and request a continuance from the judge.

A continuance may only be requested in open court on your court date. There is also no guarantee that a continuance will be granted by the court.

A continuance cannot be granted by telephone, email, internet, US Mail, or any other mail service. A continuance cannot be requested on your behalf by a friend, spouse, family member, employer, or any other person acting on your behalf, except by a lawyer who appears representing you.

Missed your court date?

Missing your court date may result in severe consequences.  An Order for Arrest may be issued and you will be arrested and may have to post bond.  Any bond already posted for your appearance in court will be forfeited by the court.

The Clerk of Superior Court cannot assist you with a missed court date.  For assistance, you must appear in person in the District Court Judges’ Office between the hours of 8:00 am and 8:30 am, Monday through Thursday, except Legal Holidays. (That office is located on the Second Floor of the Cumberland County Courthouse and telephone number is listed under “Directory of Court Offices” above). Only you, or an attorney acting on your behalf, can handle this matter.

If you missed your court date on a traffic offense and more than twenty (20) days has passed the Department of Motor Vehicles in the state where your drivers license was issued will revoke your license and you privilege to drive anywhere in the US will be suspended;  an additional ‘Failure to Appear Fee’ fee will be added to the fine and costs by the court and the Division of Motor Vehicles will add administrative fees to have your drivers license reinstated.
