All criminal offenses and infractions are filed in the criminal division of the Clerk’s office.  Criminal matters are divided into two separate divisions, and are set out below.

The Criminal Division also issues subpoena’s, orders for arrest, and bond forfeitures. Motions to Expunge Criminal Records and Innocent Owner Vehicle Impoundments are filed in this division.

District Court Division - Traffic offenses, hunting, boating and fishing, alcoholic beverage control, and worthless check as well as other infractions and misdemeanor violations of North Carolina Law are found in this division.

Cases assigned to TAC Court (Traffic Administration Court), Drug Treatment Court, Environmental Court, and criminal cases assigned to the Integrated Domestic Violence Court are also filed in this division.

Superior Court Division – Felony offenses as well as matters appealed from the District Court are found in this division.

Cases assigned to the Superior Court Case Management System are also filed in this division.

Appeals from District Court are to the Superior Court. Cases appealed from Superior Court are either to the North Carolina Court of Appeals or the North Carolina Supreme Court (based on the offense).
