Calendaring
a Special Proceedings
To
obtain your hearing date, time and place contact the Special Proceeding’s
Division. It is your responsibility to provide notice of hearing as well as
properly notice motions for continuance in accordance with the Rules of
Civil Procedure.
The
Hearing
All
special proceedings matters are heard by the Clerk of Superior
Court. It is your responsibility
to determine all forms and documents have been properly prepared, served
if required, and filed with the Special Proceedings Division prior to the
hearing. The Clerk may in her discretion, require additional information
be provided in writing, by affidavit, certified records, or under
oath. If you are required by the
Clerk to appear at the hearing you should come prepared to present
evidence at this hearing. If you fail to appear at the hearing, your
matter maybe dismissed.
Special Proceedings staff will assist you with
filing and answering procedural questions. However as with all judicial
proceedings, the Clerk's Office is expressly forbidden by law from
offering any legal advice and it is strongly recommended you seek
competent legal counsel to help you.
