Due to Statutory Requirements Upset Bid Amounts CANNOT BE PROVIDED over the telephone or by email.  It is your responsibility to:

1. Determine the amount of the upset bid

2. Make payment to the Clerk of Superior Court by Cash, Certified Check or Money Order only.)

3. Pay to the Clerk’s cashier within normal business hours when the Clerk’s Office is open within the 10 day upset bid period the amount of the upset bid. [see Location and Hours above]

The Clerk of Superior Court has statutory jurisdiction to hear and determine Special Proceedings matters.

 

Examples of such proceedings include foreclosures, adoptions and legitimization/proof of birth, incompetency/guardianship proceedings, name changes, motor vehicle liens, disputed monies, partitioning of property, boundary line disputes, and condemnation of land for public use just to name a few.

 

Petitions for filing a special proceedings action as filed in the Special Proceedings Division. 

 

Calendaring a Special Proceedings

After the special proceeding has been filed, to obtain a hearing date for a Special Proceedings, contact the Clerk of Court’s Special Proceeding’s Division.  It is your responsibility to provide notice of hearing as well as properly notice motions for continuance in accordance with the Rules of Civil Procedure.

 

 

Special Proceedings staff will assist you with filing and answering procedural questions.  However as with all judicial proceedings, the Clerk's Office is expressly forbidden by law from offering any legal advice and it is strongly recommended you seek competent legal counsel to help you.
