PROCEDURES FOR BEING
EXCUSED OR RESCHEDULED/DEFERRED FROM JURY SERVICE
Instruction for submitting requests On-line
The following instruction for requesting to be excused or
rescheduled from jury service are consistent with the Policy established
by the Chief District Court Judge.
It is the obligation of all qualified citizens to serve as jurors.
Citizens are not exempt from jury
service for reasons of employment including the nature of your job or
self-employment, or for religious beliefs. Full-time students are not
exempt from service. If a deferral is desired to a more opportune time
read the instructions below.
Jury service
may be postponed for any reason allowing jurors to report at a later or
more convenient time. If you were selected for jury service and the date
you are to report is not convenient, you may request to be rescheduled.
Deferring to a later date may resolve scheduling conflicts. Consider a slower business season, after
a work or personal problem has passed, after military deployment or
training, or a time when school is not in session or during a break. Some jurors need more time to make
arrangements for child care or elder care, or rearrange work schedules.
Other jurors may be undergoing medical problems or procedures, assisting
family members with medical issues, or have vacation or personal plans.
These are reasons to be rescheduled.
Check the
appropriate block in Section A on the back of your jury summons and provide
a more convenient time frame when you can arrange to complete your jury
service. Return the top of your summons to the address printed on the
back. Or make your request online by following the instructions printed
to the left.
Attempts will be made to honor your request. Postponements
are rarely granted for more than six months. You may be rescheduled for
one time only.
Requests must be in written form and cannot not handled by
telephone.
You may be excused from jury service for
the following reasons
You are NOT:
A citizen of the United States;
A resident of the State of North Carolina;
A resident of / or residing in Cumberland County;
At least 18 years of age;
You are 72 years of age or older and requesting to be
excused
You are physically infirmed or mentally disabled and
cannot serve
(You must provide
supporting documentation)
You have served on jury duty in a State court within the
past two years
You have been convicted of or pled guilty to a felony and
your citizenship rights have not been restored according to law.
(Citizenship rights
are restored automatically after termination of
probation or parole);
These reasons are pre-printed in Section B on your jury summons. Check
the appropriate reason and return the top of the summons to the address
printed on the back of that section. Or make your request online by
following the instructions printed to the left.
If you
are requesting to be excused from jury service for any other reason, You must appear in person in Room 102 of the Cumberland
County Courthouse any Wednesday at 2:00 P.M. before your jury
service date for a hearing by the District Court Judge to determine if
you can be excused. Excuses are
rarely granted and documentation/proof is required.
If
your request to be excused is denied, you must report
for jury service as
directed on your summons.
If
you are not rescheduled or excused before your report date, you must
report as indicated on your jury summons.
