Civil court matters are filed in
the civil division of the Clerk’s office. Civil matter are divided into 4
separate divisions based on the type of relief requested, and are set out
below:
Civil
Division – General
Civil and Civil Superior Court cases
Domestic Division- divorce, equitable distribution, child custody
& support
Domestic Violence Division – Civil Restraining Orders, No Contact Orders
Small Claims – Money
Owed (dollar
amount) or less, actions to seek the recovery of personal property
and landlord-tenant disputes.
Civil Division filings include
medical malpractice, contract, and personal injury cases just to name a
few.
The Civil Division also is
responsible for maintaining the Civil Judgment Docket where all civil
judgments in the county, liens, and many other filings required by law
are maintained for public inspection.
Civil summonses, writs of
execution, notice of rights and claim and delivery notices are issued in
the civil division.
Appeals from Small Claims Court
are to the Civil District Court. Appeals from both the District and Superior Civil Court
are to the North Carolina Court of Appeals.
Appeals from Estates and Special
Proceedings are to the Civil Superior Court; with the exception of
adoption to Civil District Court.
