‘Party Names’ are indexed as the name appears on the Will or Death Certificate and names change, spellings may differ, common names may be used, and full legal names may or may not appear on those documents. The fact that the Party Name submitted does or does not appear on the Index received is no indication that the decedent does or does not have an estate filed in Cumberland County.

 

Record searches for purposes of determining how to dispose of real or personal property is a serious matter, and the legal ramifications of information concerning the existence or non-existence of an estate controlling property can be far reaching. The search of this index is for informational purposes only.        YOU SHOULD CONTACT A LICENSED NORTH CAROLINA ATTORNEY FOR ASSISTANCE.

 

 

REQUEST FOR ESTATES RECORD SEARCH

 

I have read and understand the above notice. I request a search of the Index of official records of estates cases currently filed in the Clerk of Superior Courts Office for Cumberland County.  In making this request I understand and acknowledge that:

  1. Records are searched in Cumberland County only and not any other county or state.
  2. The records are indexed by Party Name only and not by any other identifying characteristics.
  3. The search is for the Party Name only as indicated above and not for other similar names.
  4. An estate may be filed after the search is conducted.
  5. Estates index do not contain electronic records prior to December 5, 1988.
  6. I understand that I will receive a copy of the Estates Index commencing before and after the name submitted.
  7. It is my responsibility to determine if an estate exists for the decedent, or if no estate exists by conducting an appropriate self-inspection of court files and documents.
  8. I am solely responsible for any interpretation and use I make of the results of this search and I understand the Clerk is not responsible for any interpretation or use of the results.

COPY REQUESTS

 

Complete the above Request and submit it along with the document charge and stamped self-addressed envelope.  To request copies of court documents from the record search you receive, provide the Party Name and File Number along with the title or description of the document(s) you are requesting. Upon payment of the appropriate fees, those documents will be mailed to you. 

the records of the clerk’s office are available for public inspection during normal office hours.

 

COPY fees (subject to legislative change): $2.00 for the first page of a document and $.25 for each additional page of the same document. [Example: $2.50 for a document containing 3 pages - $5.00 for two different documents each containing 3 pages]
