Court - Pursuant to Rule 29(a)(2) of the North Carolina Rules of Appellate
Procedure, the Chief Judge of the North Carolina Court of Appeals enters
the following order:
As a result of the pending retirement of two judges on this Court, the
uncertainty created by the November 5, 2002, elections in which four judges
on this Court are candidates, and the pendency of an emergency construction
project at the court, the work of the court has been disrupted. Opinions
for all cases heard by these judges before November 15, 2002, must be decided
and filed before their commissions expire. Since these judges and members
of their panels will require the remaining time of these judges' tenure to
complete and file opinions in those cases and since the panels will not have
sufficient time to hear and determine the cases appearing on the court calendar
for the week of November 18, 2002, it is ORDERED that all cases appearing
on that calendar be rescheduled for hearing after January 1, 2003.
The Clerk of the Court of Appeals is directed to notify all counsel of
record appearing in these cases that their cases will be rescheduled for
hearing after January 1, 2003.
